This Privacy Policy explains how Graphicly ("Graphicly", "we", "us" or "our") collects, uses, shares and protects information when you visit graphicly.ai, sign in to the Graphicly application, or otherwise use our services (together, the "Service"). By using the Service you agree to this Policy.
1. Who we are
Graphicly provides an online tool that helps people create graphics through a conversational interface. Graphicly is the controller of personal information processed through the Service, except where we act as a processor on your behalf (for example, for content you create and store in your account). 2. Information we collect
We collect the following categories of information:
- Account information — your name, email address, password (stored in hashed form), profile picture, workspace name and preferences.
- Content you create — designs, brand kits, uploads, templates, prompts, comments and other materials you add to the Service.
- Billing information — plan, subscription status, invoices and limited payment metadata returned by our payment processor. We do not receive or store full card numbers.
- Usage and device data — pages viewed, features used, session duration, referring URL, IP address, browser, operating system, approximate location (derived from IP), and diagnostic and crash reports.
- Support communications — messages, screenshots and attachments you send to contact@graphicly.ai.

3. How we use information
- To provide, personalize, maintain and improve the Service.
- To create and secure your account and prevent fraud and abuse.
- To process payments, manage subscriptions and issue invoices.
- To communicate with you about account, product, security and support matters.
- To send product updates and, where permitted, marketing messages — you can unsubscribe at any time.
- To meet legal, regulatory and tax obligations.
- To analyze aggregate usage and improve reliability, performance and design of the Service.
4. Legal bases for processing
Where the GDPR or similar laws apply, we rely on the following legal bases: performance of a contract (to deliver the Service you signed up for), legitimate interests (to secure, improve and market the Service in a balanced way), consent (for optional cookies and marketing where required), and compliance with legal obligations.
5. Your content
You retain all rights to the content you create with Graphicly. We access your content only as needed to operate the Service, provide support you request, investigate abuse, or comply with the law. We do not sell your content and we do not use the content of your designs, uploads or prompts to train generalized foundation models.
6. AI-assisted features
Some features use artificial intelligence to help you generate, edit and refine designs. When you use these features, your prompts and the associated context required to answer them are sent to trusted AI service providers acting under contract as our subprocessors. These providers are contractually restricted from using your inputs or outputs to train their own models. Outputs generated by AI may be inaccurate or reflect biases; you are responsible for reviewing them before publishing or distributing them.
7. Sharing and service providers
We do not sell personal information. We share information only with:
- Service providers that host our infrastructure, deliver emails, process payments, provide AI capabilities, analyze usage or help us respond to support requests. These providers act under written agreements that limit their use of information to the services they provide to us.
- Legal and safety — with authorities and other third parties when required to comply with law, respond to lawful requests, or protect the rights, property or safety of Graphicly, our users or the public.
- Business transfers — in connection with a merger, acquisition or sale of assets, in which case we will require the recipient to honor commitments made in this Policy.
8. International transfers
We may process information in countries other than the one in which you live. Where required, we use appropriate safeguards such as European Commission Standard Contractual Clauses and equivalent mechanisms to protect personal information transferred internationally.
9. Retention
We keep personal information for as long as your account is active and for a limited period afterwards to comply with legal, tax and accounting obligations, enforce our agreements, resolve disputes and protect the Service against abuse. When you delete your account we remove personal information from active systems within a reasonable period (typically within 30 days) and from backups on our regular backup rotation.
10. Security
We use technical and organizational measures designed to protect personal information, including encryption in transit, access controls, activity logging and regular reviews. No online service is completely secure; please protect your password and notify us at contact@graphicly.ai if you suspect unauthorized access to your account.
11. Your rights and choices
Subject to your local law, you may have the right to:
- Access, correct, export or delete your personal information.
- Object to or restrict certain processing, including for direct marketing.
- Withdraw consent where processing is based on consent.
- Lodge a complaint with your local data protection authority.
You can exercise most of these rights directly from your account settings, or by emailing contact@graphicly.ai. We will respond within the period required by applicable law.
12. Children
The Service is not intended for children under 16. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.
13. Changes to this policy
We may update this Policy from time to time. When we make material changes we will update the "Last updated" date above and, where appropriate, provide additional notice (for example, by email or an in-product notice).
